Letters: Do I Have To Pay Medical Bills From My Settlement?

Dear Chandler,

I was in a car accident about six months ago. Since then, I’ve been going to the chiropractor once a week for adjustments and treatment. I’ve also been getting injections for my back pain. At first, I was using my medical insurance, but the costs keep adding up and now I’m getting nervous. I’ve already spent a couple thousand in copays alone. What if I don’t get reimbursed? Who pays my medical bills after an accident? What if my settlement doesn’t end up being enough? If I have to stop making the payments will I look bad in court? Who pays my medical bills after an accident?

Dear Injured and Drowning in Debt,

Waiting for compensation for your medical bills can be stressful. The settlement process is time-consuming. But, rest assured if you keep detailed records of your treatment and seek care for injuries related to your accident from a provider, reimbursement should not be difficult.

Make sure your health care provider has your current health insurance information and list them as your primary insurer until you have other information. Make your payments as usual throughout the settlement process. If you don’t pay the bills, you can end up doing damage to your credit score.

Once your claim is settled, you will begin the subrogation process where your insurance company will be paid back by the other insurance companies involved in the case. You just have to find a way to keep up until that happens.

In some cases, you may be able to negotiate with the doctor or hospital to reduce your payments until the settlement process is complete. If negotiating on your own doesn’t work, we can put together a contract with your healthcare provider where you agree to pay the medical bills after settlement.
