Kentucky’s statute of limitations for personal injury is generally one year from the date the injury occurs. Under KRS § 413.140, you must file a lawsuit within one year of the cause of action accruing—typically the accident date—otherwise, the state may reject your claim.

Car accidents fall under a separate rule. Under the Motor Vehicle Reparations Act, you must file a claim within two years of the accident date or the last Basic Reparations Benefits (BRB) or Personal Injury Protection (PIP) payment, whichever is later.

However, several exceptions may extend or pause (“toll”) these deadlines:

  • Discovery rule: If the injury is not apparent immediately, such as a surgical complication, the one-year clock begins when you have discovered the injury or reasonably should have.
  • Minor or incapacity: If the injured party was under 18 or mentally incapacitated when injured, the deadline pauses. They have one year from turning 18 or regaining capacity to file.
  • Defendant absent or concealed: If the at-fault party left Kentucky or hid to avoid a lawsuit, the statute pauses until they return or authorities find them.

You must file a wrongful death suit generally within one year of the deceased’s death. A two-year deadline may apply if the court appoints an executor after that year but within one year of death.
